At Fast Break Process Service, we know that time is of the essence when it comes to service of process. First of all, we would like to make sure that everyone knows what being a “process server” is all about and the need for one.
In the fifth and sixth amendments of the Constitution of the United States of America, they carry the provision of a privilege for service of process to all U.S. citizens. In other words, as long as you are a U.S. citizen, you have the right to be informed when you are involved in a court case. A modern day equivalent would be an ’instant message’ to individuals concerning their constitutional right to the due process of law. As the population in a locality begins to expand, it gets more and more challenging for the local county sheriff to serve these legal papers while bearing the responsibility of looking after their jurisdiction. The need for a third party to legally hand over these papers without dawdling resulted in the formation of process servers. |
Process servers will step in to handle a wide range of tasks, including filing of court papers, serving up court documents, subpoenas, summons, complaints, writs, order to show cause, as well as document retrieval. Our main job would be to deliver or “serve” these court documents to a specific defendant or a person who is involved in a court case. This is a crucial part of the legal process, as the target would have been deemed as fully informed upon receiving these court papers.
Once we are done serving the relevant court documents, we also ensure that there is an affidavit of service, otherwise known as proof of service. The affidavit of service is a signed document that indicates a served document. The notarized affidavit of service will be handed over to the party (or parties) involved. We are well versed with the legal and lawful methods of serving papers in the Long Island area, knowing well how each state has its own process serving laws. In the event that numerous attempts have been made to locate the target without any success, then we will provide our clients with an affidavit of due diligence. |
We believe that we stand out from the rest through our high standards of professionalism as a process server in Nassau & Suffolk county. Our primary aim remains true all these years — ensuring that the due process of law is upheld in the U.S. without violating any of the laws and regulations involved in the service of process.
We also take pride in knowing that we play a vital role in civil society, making sure that all legal papers are served to the respective person(s) effectively and in an appropriate manner. This is of utmost importance as papers which are not served the right way will inadvertently affect the court hearing afterwards, since the court would be powerless to rule on a case concerning said person who has not been legally notified of the situation. A worst case scenario would see the entire case be dismissed should the service of process be deemed as improper. We have the necessary experience as a process server in Long Island and we know how to serve a defendant legally in the right way. We are a licensed process server, which should provide additional peace of mind for those who require added security. |
The going market rate hovers within the range of $40 to $150. That is a ballpark figure, but be prepared to pay for more in selected cases. There is a wide range of variables which will be reflected in the final bill. This is an indication of the relative difficulty in carrying out the task. For example, there are some targets who are always not around the listed address, hence requiring many attempts before the proper documents are served. Certain circumstances do require a particular document to be delivered during the holiday period or under short notice, and the additional effort put in will also cost more.
We are able to confidently provide our clients with relatively accurate turn-around-time (TAT) estimate. The TAT will depend on the level of service selected. Rush service, also known as same day service, will see the first attempt to serve happen within 48 hours. This particular service will cost more due to the urgency of the situation. For most of our clients, our routine service ought to be sufficient to get the job done. The routine service will see the initial attempt to serve documents to the target carried out within 3 to 5 days. We do believe in charging our clients in a fair manner based on the complexity of the situation, and take pride in delivering high quality service that is reflected in our pricing structure. Feel free to drop us any questions, including special process service needs. |
